KEEPING THE STATUS QUO DURING YOUR DIVORCE

When a Summons and Complaint is served upon a spouse so is a Notice of Automatic Orders. This document tells you that it is necessary to maintain the status quo during your divorce proceedings. If you were paying the mortgage on your house or the electric bills, you have to continue to do so throughout your divorce proceedings. Just because a divorce has been filed does not mean you can change your way of life just yet.


There can be no transferring, encumbering, assigning, removing or withdrawing of any property, retirement accounts and bank accounts. Neither spouse can incur an unreasonable amount of debt or remove or make changes to any insurance policies. These requirements are to ensure that neither spouse is put at a disadvantage while the proceedings are pending.
