How to calculate maintenance and child support

Writer: Brittany DolanBrittany Dolan

It is very simple. Both parties to the matrimonial action must provide their latest tax return to their attorney. Once their current income is determined there is a simple calculator that provides the amount of maintenance and child support that must be paid. It is a formula based solely upon the parties’ incomes. This formula also provides the parties with their pro rata share of add-on expenses for child support, such as education, unreimbursed medical and extracurricular activities. If there is child support to be paid simultaneously with maintenance, the formula will provide for the amount of maintenance that is to be paid after the child support payments end due to the emancipation of the child/children.
