CHILD SUPPORT CALCULATIONS IN NEW YORK

In New York State there is a set of guidelines for calculating child support based on a percentage of the parents’ combined incomes and number of children in the household. Typically, the non-custodial parent pays the custodial parent (i.e. the parent who cares for the children more than 50% of the time). New York law provides a three-step formula for determining what your child support obligation will be:

1. Calculate the combined income of the parent’s (commonly capped at $148,000);

2. The number of children in your household determines the percentage of support;

c. 29% of the parents combined income for three children

d. 31% of the parents combined income for four children

e. 35% of the parents combined income for five or more children

3. Calculate each parents share
